Warranty Policy

CAUTION: BY USING YOUR DAGADAM (BRANDED) HARDWARE PRODUCT(S) YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE DAGADAM ONE (1) YEAR LIMITED WARRANTY* (“WARRANTY”) AS SET OUT BELOW.

WARRANTY* – A WRITTEN GUARANTEE OF THE INTEGRITY OF A PRODUCT AND OF THE PRODUCER’S RESPONSABILITY FOR THE REPAIR OR REPLACEMENT OF DEFECTIVE PARTS PLEASE CAREFULLY READ THE TERMS OF THE WARRANTY BEFORE USING THE PRODUCT. IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT WITHIN THE RETURN PERIOD STATED IN DAGADAM’S RETURN POLICY (FOUND HERE) TO THE AUTHORIZED DISTRIBUTOR WHERE YOU PURCHASED IT FOR A REFUND OR DIRECTLY TO US AT THE ADDRESS THAT THE PRODUCT WAS SENT FROM OR AT A NEW ADDRESS THAT DAGADAM’S TEAM ADVICE YOU ( BEFORE SENDING THE PRODUCT, YOU MUST SEND AN EMAIL TO OUR WARRANTY TEAM ABOUT THE PROBLEM (‘S) THAT YOU ENCOUNTERED WITH THE PRODUCT (‘S) AND OUR TEAM WILL ADVICE YOU HOW TO PROCEED FURTHER).

HOW CONSUMER LAW RELATES TO THIS WARRANTY

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). FOR A FULL UNDERSTANDING OF YOUR RIGHTS YOU SHOULD CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE OR STATE.

WARRANTY COVERAGE

Dagadam LTD of 288 Jeans Way, Dunstable, United Kingdom, LU5 4PT (“DAGADAM”), company number: 10473511, warrants the Dagadam-branded hardware product(s) and Dagadam-branded accessories contained in the original packaging (“Dagadam Product”) against defects in materials and workmanship when used normally* for a period of ONE (1) YEAR from the date of the original purchase by the end-user purchaser named “Warranty Period” (ONE YEAR).
*A normal usage of a Dagadam-branded hardware product(s) is induced/presented on our official website https://dagadam.com (“Official Website“).
The product is used in or for the purpose for which it was created. Our official website presents the functions and shows the purpose of our product(s). Dagadam LTD won’t accept other “unnatural” purpose that may be interpreted or induced.

NOT COVERED BY WARRANTY

This Warranty does not apply to any non-Dagadam branded hardware product(s), even if packaged or sold as Dagadam-branded product(s). This does not affect your rights under applicable consumer law. All entities that can sell Dagadam-branded products need to be authorized by Dagadam. We advise you to consult an authorized Dagadam Store (“Physical Store” or “Online Store”) in order the warranty to be valid. Software distributed by Dagadam with or without the Dagadam brand (including, but not limited to system software) is not covered by this Warranty. Dagadam Product(s) may have licensed software from a third party partner, but Dagadam does not guarantee functionality, uninterrupted operation or bugs-free.
This Warranty does not apply to:
* All the points below will be related to Dagadam-branded product(s) that do not have a factory defect in materials or workmanship;

  1. consumable parts: batteries or protective coatings that are designed to diminish over time;
  2. cosmetic damages: scratches, dents and cracks (including, but not limited);
  3. damages caused by use with a third-party component(s) or product(s);
  4. damages caused by accident, abuse, misuse, fire, earthquake or other external cause (including, but not limited);
  5. damages caused by operating the Dagadam Product(s) outside of its(their)”natural” purpose;
  6. damages caused by service (including upgrades and expansions) performed by anyone who is not authorized by Dagadam;
  7. a Dagadam Product(s) whose functionality or capability has been modified or altered without the written permission of Dagadam;
  8. defects caused by normal wear and tear or otherwise due to the normal aging of theDagadam Product(s);
  9. if any serial number has been removed or defaced from the Dagadam Product(s);
  10. if you cannot prove in any way that you are the authorized user of the product(s) (eg. by presenting proof of purchase).

*RESTRICTION: Dagadam may restrict or change the warranty service for its hardware or software product(s).

YOUR RESPONSIBILITIES

All the issues encountered with Dagadam product(s) need to be reported to Dagadam’s team (by email) to consider and fix them as quickly as possible.
Before receiving the warranty service, the user must show proof of payment of the product(s), answer the questions that will assist the product diagnosis and follow the Dagadam team’s warranty procedures.
The product(s) sent to the warranty service must be password-free and all the personal data removed. During warranty service the contents of the storage media will be deleted and reformatted. Dagadam and its authorized agents are not responsible for any loss of software programs, data or other information contained on the storage media or any other part of the Dagadam product(s) serviced.
After completing the warranty process, the product(s) may be repaired or replaced and returned to the user in the original configuration. Dagadam may install system software updates as part of warranty service that will prevent the Dagadam Product(s) from reverting to an earlier version of the system software.
The applications or any other information installed/uploaded by the user will be deleted. Certain applications may not work after installing the latest update during the warranty process. The user is responsible for reinstalling the applications and uploading the information to the Dagadam product(s). Recovering and installing other software, data or information is not covered by this Warranty.
The user of the Dagadam product(s) must keep all the outside and inside content of the original box in which the Dagadam product(s) is sold for the Warranty’s validity. Loss or excessive damage (the information required for the warranty process can no longer be decipherable) to the material and informational content of the package (box) in which the product(s) is sold may invalidate the Warranty.

CAUTION: DO NOT ATTEMPT TO OPEN, REMOVE OR REPLACE ANY PART(S) OF THE DAGADAM PRODUCT(S). DAGADAM MAY NOT ACCEPT A PRODUCT(S) THAT HAVE UNDERGONE EXTERNAL ACTIONS AND THIS MAY CANCEL THE WARRANTY.

WHAT WILL DAGADAM DO IN THE EVENT THE PRODUCT(S) HAS MALFUNCTIONS OR PRODUCTION FAULTS?

NOTE: EXCLUDING THE POINTS THAT ARE NOT COVERED BY THIS WARRANTY

If during the Warranty Period you submit a claim to Dagadam in accordance with this warranty, Dagadam will, at its option:

  1. Dagadam can repair the product(s) with new or used parts that are equivalent to product(s) functionality;
  2. Dagadam can replace the product(s) with the same model or the same functionality product(s) as the product(s) that benefits from this warranty (if the user agrees to do so). The replacement product(s) must be equivalent to the replaced product(s) performance and reliability;

NOTE: THE REPLACED PRODUCT(S) BECOMES DAGADAM’S PROPERTY AND THE REPLACEMENT PRODUCT(S) BECOMES THE PROPERTY OF THE USER

OBTAINING WARRANTY SERVICE

After purchasing a Dagadam product(s) from our official website (https://dagadam.com) or from one of our authorized distributors, the user must enroll the product on our website in the “Warranty” section to activate the warranty. The registration is done by first authenticating the product with the following information: User’s Name, User’s Email and the Unique Production Batch Code.

NOTE: ALL DAGADAM PRODUCTS MUST BE REGISTERED FOR WARRANTY ACTIVATION WITHIN 5 (FIVE) BUSINESS DAYS FROM THE DAY OF PURCHASE. ANY REGISTRATION THAT EXCEEDS 5 (FIVE) BUSINESS DAYS FROM THE PURCHASE OF THE PRODUCT MAY AFFECT THE VALIDITY OF THE WARRANTY.

If the user encounters problems in activating the warranty, he/she should contact us online (https://dagadam.com/contact/warranty) to solve the issue.

CAUTION: ALL DAGADAM-BRANDED PRODUCTS HAVE A UNIQUE WARRANTY ACTIVATION CODE (PRODUCTION BATCH SERIES), WHICH MAY COINCIDE WITH THE PRODUCT SERIAL NUMBER

WARRANTY SERVICE PROCESS

To use the Dagadam Warranty service, the user should email Dagadam’s Warranty Team through the online “Warranty” contact form on our official website (https://dagadam.com/contact/warranty) explaining the issue.
The Dagadam warranty team will respond, as soon as possible, with the steps the user needs to take to solve the issue. In most cases, the user will need to send the product(s) (via courier) to the address specified by the Dagadam’s Warranty Team to begin the Warranty process.
The package sent to the Dagadam’s Warranty Team must contain all the original materials and all the information on the box should be decipherable. The buyer’s name (from the purchase invoice) must coincide with the name of the person who enrolled the product(s) to activate the warranty. If the product(s) is bought by someone other than the owner of the product(s), for various reasons, the person who bought the product(s) must authorize the owner by means of a letter to that effect.

NOTE: THE COSTS CHARGED BY THE COURIER COMPANY WILL BE REFUNDED BY DAGADAM IF THE PRODUCT IS VALIDATED FOR THE WARRANTY PROCESS, OTHERWISE THE USER WILL HAVE TO PAY THE SHIPPING COSTS.

The user may be responsible for shipping and handling charges if the Dagadam Product(s) cannot be serviced in the country of residence in the case that the country in which the product was purchased has a Dagadam service point. If the user needs service in a country that is not the original country of purchase, he may comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges.

LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAGADAM IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF REVENUE, LOSS OF ACTUAL OR ANTICIPATED PROFITS, LOSS OF THE USE OF MONEY, LOSS OF ANTICIPATED SAVINGS, LOSS OF BUSINESS, LOSS OF OPPORTUNITY, LOSS OF REPUTATION, LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA, OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE DAGADAM PRODUCT(S) OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED ON THE DAGADAM PRODUCT(S).
THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. DAGADAM DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY DEVICE UNDER THIS WARRANTY OR REPLACE THE DAGADAM PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED IN
THE DAGADAM PRODUCT.
NOTE: SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

GENERAL

NO employee, distributor or agent is authorized to make alterations or add other clauses to this warranty, these actions being illegal and unenforceable. In any event, the terms of the original Dagadam Warranty are not affected or impaired.
